The Safety, Health and Welfare Act, 2005 imposes a legal obligation on all employers and organisations to ensure the Safety, Health and Welfare of employees within a work place.
Section 80 of the SHWW Act 2005 provides that when an undertaking (i.e. a business or other organisation) is convicted of an offence - and the doing of the acts that constitute the offence have been authorised, consented to or are attributable to connivance or neglect on the part of a director, manager or other officer of the undertaking - that person, as well as the undertaking, shall be liable to prosecution personally and to be punished as if he/she was guilty of the offence.
